1. Scope of Application
These Terms and Conditions (T&C) apply to all services provided by Studio Avantgarde via the website.
2. Subject of Contract / Business Relationship
The services offered are defined in the respective agreement. A binding contract is concluded once the client places an order and Studio Avantgarde confirms it.
3. Client Cooperation
The client shall provide all necessary information and documents required for the performance of the services in a timely and complete manner.
4. Third-Party Service Providers
Studio Avantgarde may engage qualified third parties for the fulfillment of services, subject to confidentiality obligations.
5. Fees and Payment Terms
Fees are charged as agreed in the contract, either on a flat-fee or time-spent basis. Studio Avantgarde may request advance payments or issue interim invoices.
6. Confidentiality
Both parties agree to treat all information obtained during the cooperation as confidential. This obligation remains in effect even after termination of the contract.
7. Intellectual Property / Usage Rights
Studio Avantgarde retains ownership of all intellectual property rights. The client receives a non-exclusive, non-transferable right of use to the deliverables unless otherwise agreed.
8. Liability
Studio Avantgarde is liable for intent and gross negligence. For slight negligence, liability is limited to the contract value. Liability for consequential damages is excluded.
9. Warranty
In case of defects, the client is entitled to rectification. If rectification fails, the client may request a price reduction or termination of the contract. Further claims are governed by clause 8.
10. Term and Termination
The contract may be terminated in writing by either party at any time. The client is obliged to pay for all services provided up to that point.
11. Data Protection
Studio Avantgarde complies with applicable Swiss data protection laws and implements appropriate technical and organizational measures to protect personal data.
12. Governing Law and Jurisdiction
Swiss law applies exclusively. The place of jurisdiction is Zurich, Switzerland, or the registered office of Studio Avantgarde.
